Welcome to StayAtAloha, operated by RAHUL KHANNA HUF (GST: 30AAXHR1935E1Z3). These Terms and Conditions (“Terms”) govern your use of our website https://www.stayataloha.com and your booking of vacation rental properties in Goa, India.

By accessing our website or making a booking, you agree to be bound by these Terms. Please read them carefully before proceeding.


1. Definitions

  • “We,” “Us,” “Our”: RAHUL KHANNA HUF, operating as StayAtAloha
  • “Guest,” “You,” “Your”: The person making a booking or using our services
  • “Property”: The vacation rental accommodation booked through our services
  • “Booking”: A confirmed reservation for a Property
  • “Check-in”: The start date and time of your stay
  • “Check-out”: The end date and time of your stay
  • “Services”: All services provided by StayAtAloha

2. Booking and Reservations

2.1 Booking Process

  • All bookings must be made through our website, phone, email, or WhatsApp
  • A booking is confirmed only upon receipt of payment and written confirmation from us
  • All guests must be 18 years or older to make a booking

2.2 Booking Confirmation

Upon successful booking, you will receive:

  • Booking confirmation via email/WhatsApp
  • Property details and address
  • Check-in instructions
  • Payment receipt
  • House rules and guidelines

2.3 Accuracy of Information

  • You must provide accurate and complete information during booking
  • You are responsible for verifying all booking details (dates, number of guests, property selection)
  • Errors in booking information should be reported immediately

2.4 Availability

  • All properties are subject to availability
  • We reserve the right to decline bookings at our discretion
  • Property availability displayed on our website is updated regularly but may not be real-time

3. Pricing and Payment

3.1 Pricing

  • All prices are listed in Indian Rupees (INR)
  • Prices include applicable taxes unless otherwise stated
  • GST will be charged as per Indian tax laws
  • Prices are subject to change without notice for future bookings

3.2 Payment Terms

For Direct Bookings:

  • 50% advance payment required to confirm booking
  • Remaining 50% due at the time of check-in

Accepted Payment Methods:

  • Bank transfer/NEFT/RTGS
  • UPI
  • Credit/Debit cards (through payment gateway)
  • Other methods as communicated

3.3 Security Deposit

  • A refundable security deposit may be required (amount varies by property)
  • Deposit amount will be communicated at time of booking
  • Deposit is refundable within 2 days after check-out, subject to property inspection
  • Deductions may be made for damages, missing items, or violations of house rules

3.4 Additional Charges

You may be charged for:

  • Extra guests beyond the agreed number
  • Early check-in or late check-out (subject to availability)
  • Additional cleaning services
  • Damages to property or furnishings
  • Lost keys or access cards
  • Violation of house rules

4. Cancellation and Refund Policy

4.1 Cancellation by Guest

Standard Cancellation Policy:

  • 30+ days before check-in: Full refund
  • Less than 30 days before check-in: No refund
  • No-show: No refund

Non-Refundable Bookings:

  • Some promotional rates may be non-refundable
  • Non-refundable bookings will be clearly marked at time of booking

4.2 Cancellation by StayAtAloha

We reserve the right to cancel bookings in cases of:

  • Force majeure events (natural disasters, pandemics, government orders)
  • Property damage or unavailability
  • Guest misconduct or violation of terms
  • Fraudulent bookings

In case of cancellation by us:

  • Full refund of all payments made
  • No liability for additional costs or consequential losses

4.3 Modification of Bookings

  • Modification requests subject to availability
  • Changes made within 7 days of check-in may incur charges
  • Date changes treated as new bookings if availability is limited

4.4 Refund Processing

  • Refunds processed within 2-4 business days
  • Refunds made to the original payment method
  • Bank processing times may vary

5. Check-in and Check-out

5.1 Check-in

  • Standard check-in time: 2:00 PM
  • Early check-in subject to availability (additional charges may apply)
  • Valid government-issued photo ID required for all guests
  • Foreign nationals must provide passport and visa details
  • Maximum occupancy limits must be strictly followed

5.2 Check-out

  • Standard check-out time: 10:00 AM
  • Late check-out subject to availability (additional charges may apply)
  • Property must be left in reasonable condition
  • All keys/access cards must be returned

5.3 Guest Registration

  • As per Indian hospitality regulations, all guests must be registered
  • Required information: Name, address, ID proof, contact details
  • Failure to provide required information may result in booking cancellation without refund

6. Guest Responsibilities and Conduct

6.1 Property Use

  • Properties are for short-term vacation rental only
  • Commercial use strictly prohibited
  • Subletting or unauthorized third-party use not permitted
  • Guest count must not exceed booked capacity

6.2 House Rules

Guests must adhere to property-specific house rules, including but not limited to:

  • No smoking inside properties (unless designated areas)
  • No illegal activities or substances
  • Respect for neighbors and quiet hours (typically 10 PM – 8 AM)
  • Proper waste disposal
  • No pets
  • No parties or events without prior written consent

6.3 Property Care

  • Treat property and furnishings with care
  • Report damages or maintenance issues immediately
  • Responsible for damages caused during stay
  • Return property in the condition received (normal wear and tear excepted)

6.4 Safety and Security

  • Secure the property when leaving
  • Do not share access codes or keys with unauthorized persons
  • Follow all safety instructions provided
  • Report suspicious activities or security concerns immediately

7. Liability and Indemnification

7.1 Limitation of Liability

StayAtAloha and RAHUL KHANNA HUF are not liable for:

  • Loss, theft, or damage to personal belongings
  • Personal injuries sustained on the property (except due to our negligence)
  • Interruptions in utilities or services beyond our control
  • Natural disasters, acts of God, or force majeure events
  • Third-party services or products recommended by us

7.2 Guest Liability

Guests are liable for:

  • Damages to property, furnishings, or equipment
  • Violations of house rules or local laws
  • Disturbances to neighbors or other guests
  • Any costs incurred due to guest misconduct

7.3 Indemnification

Guests agree to indemnify and hold harmless StayAtAloha, RAHUL KHANNA HUF, and our representatives from any claims, damages, or expenses arising from:

  • Guest’s use of the property
  • Violation of these Terms
  • Violation of any laws or regulations
  • Damage to property or third-party claims

7.4 Insurance

We strongly recommend guests purchase travel insurance covering:

  • Trip cancellation
  • Medical emergencies
  • Personal liability
  • Loss of personal belongings

8. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including:

  • Natural disasters (earthquakes, floods, cyclones)
  • Pandemics or health emergencies
  • Government orders or restrictions
  • War, terrorism, or civil unrest
  • Strikes or labor disputes
  • Utility failures or infrastructure breakdowns

In such events, we will work with guests to find reasonable solutions, which may include:

  • Rescheduling the booking
  • Partial or full refunds (at our discretion)
  • Alternative accommodation options

9. Privacy and Data Protection

9.1 Personal Information

  • We collect and process personal information as described in our Privacy Policy
  • Guest data is used only for booking management and service delivery
  • We comply with applicable data protection laws

9.2 Communication

  • Guests consent to receive booking-related communications via email, SMS, or WhatsApp
  • Marketing communications sent only with explicit consent
  • Unsubscribe options provided in all marketing communications

10. Intellectual Property

10.1 Website Content

  • All content on our website (text, images, logos, designs) is owned by RAHUL KHANNA HUF
  • Protected by copyright and intellectual property laws
  • Unauthorized use, reproduction, or distribution prohibited

10.2 User-Generated Content

By submitting reviews, photos, or other content:

  • You grant us a non-exclusive, royalty-free license to use such content
  • You confirm you own the rights to submitted content
  • We reserve the right to remove inappropriate content

11. Dispute Resolution

11.1 Complaints

12.2 Notification

  • “Last Updated” date indicates most recent revision
  • Guests encouraged to review Terms periodically

13. Severability

If any provision of these Terms is found to be invalid or unenforceable:

  • That provision will be modified to reflect the parties’ intention
  • Remaining provisions remain in full force and effect

14. Entire Agreement

These Terms, together with our Privacy Policy and property-specific house rules, constitute the entire agreement between you and StayAtAloha.
